These Terms of Service (“Terms”) govern your access to and use of the EVCLAS platform, website, and related services (collectively, the “Services”) operated by EVCLAS LLC (“EVCLAS,” “Company,” “we,” “us,” or “our”).

By accessing or using our Services, you agree to be bound by these Terms.

1. Eligibility

You must be at least 18 years old to use our Services.

Drivers must:

• Possess a valid driver’s license

• Maintain required vehicle insurance

• Meet EVCLAS vehicle and background requirements

• Operate a Tesla vehicle approved by EVCLAS

EVCLAS reserves the right to approve or deny driver applications at its sole discretion.

2. Nature of the Service

EVCLAS is a technology platform that connects independent drivers with riders seeking transportation services.

EVCLAS does not provide transportation services and does not employ drivers. All drivers operate as independent contractors.

3. Payments

Riders agree to pay all applicable fees associated with trips booked through the platform.

Payments are processed through third-party payment providers. EVCLAS is not responsible for payment processing errors outside its control.

4. User Conduct

Users agree not to:

• Violate any local, state, or federal laws

• Use the platform for fraudulent purposes

• Harass drivers or riders

• Damage vehicles or property

EVCLAS may suspend or terminate accounts for violations.

5. Limitation of Liability

To the fullest extent permitted by law, EVCLAS shall not be liable for:

• Indirect or consequential damages

• Loss of profits

• Personal injury resulting from driver actions

Transportation services are provided by independent drivers.

6. Account Termination

EVCLAS may suspend or terminate user accounts at any time for violation of these Terms or safety concerns.

7. Changes to Terms

We may update these Terms at any time. Continued use of the Services constitutes acceptance of updated Terms.

8. Governing Law

These Terms shall be governed by the laws of the State of Washington, United States.

The Services are provided on an “as is” and “as available” basis. EVCLAS makes no warranties, express or implied, regarding the reliability, availability, or suitability of the Services.

EVCLAS does not guarantee uninterrupted access or error-free functionality.

11. Safety Disclaimer

EVCLAS is a technology platform only. Drivers are independent contractors and are solely responsible for the operation of their vehicles and compliance with all applicable laws.

EVCLAS is not responsible for the conduct, actions, or omissions of drivers or riders.

12. Indemnification

You agree to indemnify and hold harmless EVCLAS LLC, its officers, owners, and affiliates from any claims, damages, liabilities, and expenses arising out of:

• Your use of the Services

• Violation of these Terms

• Violation of applicable law

13. Dispute Resolution & Arbitration

Any dispute arising out of or relating to these Terms shall be resolved through binding arbitration in the State of Washington, except where prohibited by law.

Users waive the right to participate in class actions.
